These Terms of Service govern the use of the Fit-Studio online platform, available at fit-studio.eu, operated by the entity identified below (hereinafter: "Service Provider"):
By using the Service, you agree to be bound by these Terms in their entirety.
Registration in the Service is voluntary and free of charge. The User agrees to provide accurate information during registration.
The User is responsible for maintaining the confidentiality of their Account login credentials.
The Service Provider reserves the right to suspend or delete an Account in case of a breach of these Terms.
The User agrees to use the Service in accordance with applicable law, these Terms, and good practices.
The following is prohibited in particular:
Responsibility for uploaded materials: The User represents and warrants that they hold all necessary rights, licences, and consents to the materials uploaded to the Service, including the right to use the likeness of any persons depicted in the photographs. The User bears sole responsibility for content uploaded to the Service and for any infringement of third-party rights, including copyrights, personality rights, and trademarks. Should any third party raise claims against the Service Provider in connection with materials uploaded by the User, the User undertakes to indemnify the Service Provider and to cover all reasonable costs related thereto.
The Service Provider reserves the right to remove materials that violate these provisions without prior notice to the User and to suspend or delete the Account in the event of repeated violations.
The Service uses artificial intelligence technology to generate images based on product photographs uploaded by the User.
The Service Provider does not guarantee specific results from AI image generation. Results may vary depending on the quality of the uploaded materials and generation parameters.
The User acknowledges that AI-generated images are illustrative in nature and may contain imperfections.
AI Transparency: In accordance with the requirements of Regulation (EU) 2024/1689 of the European Parliament and of the Council (the AI Act), the Service Provider informs that all images generated through the Service are created using artificial intelligence. The User is responsible for appropriately labelling AI-generated content in their marketing and commercial materials, in accordance with applicable law.
Third-Party Providers: The Service uses artificial intelligence technology supplied by third-party entities (Third-Party Providers). The Service Provider is not liable for interruptions, quality changes, or unavailability of Third-Party Provider services. In the event of temporary unavailability of AI technology due to reasons attributable to Third-Party Providers, the Service Provider shall make every effort to restore the service as soon as possible. Such interruptions do not constitute a breach of these Terms.
All intellectual property rights to the Service, including its graphic design, source code, logos, and trademarks, belong to the Service Provider.
The User retains rights to their uploaded materials. By uploading materials to the Service, the User grants the Service Provider a licence to process them for the purpose of providing the services.
Rights to AI-generated content: The User acquires full rights to use images generated through the Service for commercial purposes, including sales, marketing, publication on social media, in catalogues, online shops, and advertising materials, in accordance with the scope of the purchased package. The Service Provider does not claim copyright to content generated at the User's request.
The Service offers various Credit packages for generating AI images. Package details and pricing are available on the Service website.
Payments are processed through an external payment operator. The Service Provider does not store Users' payment card data.
Purchased Credits are non-refundable for cash and have no expiration date unless the offer terms state otherwise.
Consumers have the right to withdraw from a distance contract within 14 days of its conclusion, without providing a reason.
The right of withdrawal does not apply if the User has used the purchased Credits (commenced use of the digital service with explicit consent before the withdrawal period expires).
Complaints may be submitted via the contact form available in the Contact section of the Service. The Service Provider will process the complaint within 14 days of receipt.
The Service Provider makes every effort to ensure the Service operates correctly, but does not guarantee uninterrupted or error-free availability of the Service.
The Service Provider shall not be liable for damages resulting from the use of the Service in violation of the Terms or applicable law.
The Service Provider's liability towards Users who are businesses is limited to the value of the purchased package, but in no case shall it exceed the total amount paid by the User in the 12 months preceding the event giving rise to the claim.
The Service Provider shall not be liable for indirect damages, lost profits, loss of data, or interruptions to the User's business operations, except in cases of intentional harm.
Force Majeure: The Service Provider shall not be liable for non-performance or improper performance of obligations under these Terms if caused by Force Majeure. In the event of Force Majeure, the deadline for fulfilling obligations shall be extended by the duration of the impediment. The Service Provider shall promptly inform Users of the occurrence and cessation of Force Majeure.
The controller of Users' personal data is the Service Provider. Detailed information regarding the processing of personal data can be found in the Privacy Policy available in the Service.
The Service Provider reserves the right to amend these Terms. Users will be notified of changes electronically at least 14 days before the changes take effect.
Continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
Matters not regulated by these Terms shall be governed by Polish law.
Any disputes arising from the use of the Service shall be resolved by the court having jurisdiction over the registered office of the Service Provider, subject to consumer rights under applicable law.
These Terms come into effect on the date of publication in the Service.
